Construction teams often use the word escrow for several different arrangements: a licensed third-party escrow account, a project bank account, a payment-provider balance, or an internal software ledger. Those arrangements are not interchangeable.
Before relying on an escrow claim, identify who legally holds the funds, under which agreement, at which institution, who can authorize release, and how the records reconcile to the provider statement.
Separate workflow from custody
Software can implement milestone controls without itself becoming the legal custodian of customer funds. A clear product should distinguish the following layers.
- Contract layer: scope, milestones, approval rights, retainage, disputes, and remedies.
- Application layer: evidence, review state, approvals, invoices, fees, and audit history.
- Provider layer: account ownership, custody, transfer eligibility, settlement, and reversals.
- Reconciliation layer: proof that provider activity and application records agree.
Human-authorized milestone review
Photos and field records can help an authorized reviewer understand a submission. AI may summarize visible evidence or flag uncertainty, but it is not a licensed inspection and should not trigger an automatic release.
The approval record should identify the reviewer, evidence, decision, time, and resulting payment state.
Questions for any construction escrow product
Obtain answers from the provider agreement, account records, and qualified advisers—not only marketing copy.
- Who is the legal account holder and custodian?
- Is the service available for the project parties and jurisdictions involved?
- What KYB/KYC, sanctions, licensing, and transaction limits apply?
- How are disputes, refunds, chargebacks, insolvency, and abandoned funds handled?
- Can each release be reconciled to a provider transaction and bank statement?
